COMPARATIVE REFERENCE TO THE WOMEN'S PENITENTIONAL CONDITIONS - CLOSED IN THE COUNTRIES OF THE FORMER YUGOSLAVIA

Abstract

The penitentiary institution and the prison society are inevitable for consideration when we start talkink about the crime and its serious manifestations. The class society, in its development and all the alternatives that is offering, has not yet found a more effective way for preventing the crime. In surroundings where human freedom becomes the most important and most comprehensive protected right, the true value of this punishment is more than clear. And no matter how much is talked or alarmed about the negative deprivations of the imprisonment, and for the institution as a "university of crime", the punishment itself, is still shown to be the most used in the direction of re-education and overall re-socialization.

The woman is not without a reason named as a “lower” sex in criminology, when it comes to committing the crimes, their kind, the way to her punishment, and it would be particularly wrong if the experiences that we get from the male prisoners, we take them as general for all the prisoners, regardless their sex. It is a fact that women are far less represented into the than total prisoners’ population anywhere in the world, but they perceive deprivation of liberty so differently, as well as the overall serving of sentences and the consequences thereof, the separate study and surveys are inevitable. What is imposed, as necessary, is the analyze above  all the conditions, in and under, which the woman is serving the prison sentence. Below is a comparative overview of the conditions under which women, from the countries of the former Yugoslavia, are serving their sentences, as well as the conclusions on how much these countries have evolved over the years in achieving the minimum rights of women-inmates.
