НОВАТА ЕВРОПСКА ДИРЕКТИВА ЗА ЕКОЛОШКИ КРИМИНАЛ: ИМПЛИКАЦИИ ЗА РАЗВОЈОТ НА КРИВИЧНОПРАВНАТА ЗАШТИТА НА ЖИВОТНАТА СРЕДИНА ВО СЕВЕРНА МАКЕДОНИЈА

Еколошкиот криминал претставува значаен предизвик за современите правни системи, особено во контекст на зголемените ризици кои директно влијаат врз здравјето на луѓето, животните и одржливиот развој. Во таа насока, Европската Унија презема мерки за зајакнување на кривичноправната заштита на животната средина преку донесувањето на Директивата (ЕУ) 2024/1203 за заштита на животната средина преку кривичното право, со која се наметнуваат построги стандарди за инкриминација, санкционирање и институционална соработка во борбата против еколошкиот криминал, при што се заменуваат претходните директиви во оваа област. Предмет на овој труд е анализа на основните решенија содржани во новата директива, како и нивното значење за развојот на кривичноправната заштита на животната средина. Преку примена на компаративната и нормативната анализа се разгледуваат можностите и предизвиците поврзани со усогласувањето на националното законодавство на Република Северна Македонија со современите европски стандарди во областа на еколошкото кривично право. Анализата укажува на потребата од понатамошно унапредување на националната правна рамка, но и посериозна примена на истата со цел обезбедување поефикасна кривичноправна заштита на животната средина. Воедно, трудот има за цел да придонесе кон научната дебата за улогата на кривичното право во заштита на животната средина во услови на современи еколошки предизвици.
