POSSESSION – IT IS POSSIBLE TO INHERIT AS FACTUALRELATIONSHIP?

This present report will focus on possession and on whether it is capable
of being inherited. It will examine the question of whether possession
may be inherited as a fact, under what prerequisites, and whether a
transfer of possession or an accession of the factual relationship is
required. Of particular interest is whether the effect in rem of acquisitive
prescription will arise where the heir invokes a period of acquisitive
prescription that has run in favor of his testator/intestate predecessor, but
after he himself has lost possession of the property for more than six
months.
