LEGAL QUALIFICATION OF HOMICIDE IN THE REPUBLIC OFSERBIA: NORMATIVE FRAMEWORK AND ISSUES OF DISTINCTION INCASE LAW

Although homicide offences are regulated by the Criminal Code of the
Republic of Serbia, distinguishing between their individual forms in case
law continues to raise issues concerning their proper legal qualification.
Different interpretations of statutory elements may result in different
legal qualifications of factually similar cases, thereby raising the question
of the consistent application of statutory criteria when distinguishing
between individual forms of homicide offences. The subject of this paper
is the analysis of the normative framework and the issues arising in the
distinction between individual forms of homicide offences in the case law
of the Republic of Serbia. The aim of the research is to examine the extent
to which the interpretation and application of statutory elements affect
the proper legal qualification of individual forms of homicide offences.
The paper employs normative, doctrinal and statistical methods, together
with an analysis of relevant case law and statistical data on persons
reported, accused and convicted of homicide offences in the Republic of
Serbia during the period from 2020 to 2024. The findings indicate that
the key issues concerning legal qualification primarily arise from
differences in the interpretation and application of statutory elements in
case law. The findings confirm the need for a more consistent application
of statutory criteria and greater consistency in case law in order to ensure
proper legal qualification and the uniform application of substantive
criminal law.
