MEASURES TO ENSURE THE PRESENCE OF PERSONS IN THE CRIMINAL PROCEDURE THROUGH THE PRACTICE OF OS STRUMICA IN THE PERIOD FROM 2015-2021

Abstract

In the fight against crime, the best results are achieved and the greatest effect is achieved, if we have effective criminal prosecution, which means quick detection of criminal cases and their perpetrators, fast, clear and legally conducted proceedings against the perpetrators, as well as sentencing with an appropriate court verdict. Coercive measures, although they are necessary, and all procedural systems allow their use, restrict the fundamental rights of the suspect or accused.The content of such rights and freedoms are declared by international conventions and constitutions of states and detailed conditions of their limitations are regulated in national acts on criminal procedure. Republic of North Macedonia is not an exception either in terms of the application of coercive measures, nor in terms of violations of human rights and freedom.
