CRIMINOLOGICAL ASPECTS OF THE CRIME OF MURDER IN THE TERRITORY OF THE REPUBLIC OF NORTH MACEDONIA AND ITS OCCURRENCE, IN THE PERIOD FROM 2000-2019

Abstract

Blood crimes or crimes against life and body include all actions that attack the life and bodily integrity of a person. A typical representative of that group of crimes, and a crime that attacks perhaps the most important human right, is murder. It attacks life, which is a biologically-sociologically unique phenomenon, a process whose different stages, for the legislator, are equal. The right to life is a natural human right, based on the Universal Declaration of Human Rights, which states that every person has the right to life. Analogous to the declaration, Article 10 of the Constitution of the Republic of Macedonia states that human life is inviolable.  In the Republic of Macedonia, the death penalty cannot be imposed on any basis. If we are talking about the crime of murder, it would be mentioned here that the same thing exists all over the world, the same thing is present everywhere, regardless of race, ethnicity, skin color, national affiliation, gender, religion and class. Historically speaking, murder has always existed, existed in the past, exists now and will exist in the future because as an act, although it is punishable, murder as such is specific in itself and although the state and the judicial authorities strive to eradicate it completely, it is almost impossible and cannot be prevented. Murder is criminalized by law, the purpose of criminalization itself is actually to punish all forms of murder. But from the point of view of incrimination, it will not be enough just to incriminate the murder, but it is also necessary to do a deep analysis in terms of what are the most common reasons for its occurrence, in which forms it can appear, i.e. in what way it can be manifests, on whom it can be perpetrated, what are the consequences of such violence, in order for people to be able to more easily assess whether they are potential victims of the crime itself, although, for the specific crime, it is almost impossible from a victimological point of view, that is, for the victim to notice before time that she herself could be a potential victim of the act of murder itself, if we look through the prism of murder and its criminological aspects.
