Концептуални постановки на непосредното и посредното застапништво, vis-à-vis откриеното и неоткриеното застапништво
Abstract
Во трудот го разгледуваме прашањето за евентуалните концептуални разлики помеѓу непосредното и посредното застапништво,од една страна, и откриеното и неоткриеното застапништво, од друга страна. Претходно го разгледуваме прашањето за постоењето единствен концепт на застапништвото, во civil law системите и во common law системите, за во понатамошниот текст да се задржиме единствено на волјевото застапништво. Притоа, одвоено ги разгледуваме ситуациите кога агентот дејствува во името на принципалот и се воспоставува однос на непосредно застапништво и ситуациите кога агентот дејствува во свое име, но за сметка на принципалот, па се воспоставува однос на посредно застапништво. Потоа се задржуваме на состојбата во common law системите, кога имаме именуван принципал, неименуван принципали неоткриен принципал. Следејќи ги наведените анализи, изведуваме заклучок дека, и покрај функционалните сличности, ситуациите на посредно и на неоткриено застапништво не треба да се поистоветуваат. Што се однесува на генералните концептуални постановки, сметаме дека принципот на публицитет, со определени исклучоци, треба да се задржи.
