Abstract

This paper elaborates the meaning that an offer has as an initial act in concluding a
contract of sales in everyday life. The legal regulation of an offer allows for more dynamic
and more fluid development of contractual relations and concluding of contract of sales.
The main area of research in this paper is the legal regulation of an offer in contracts
of sale of goods, i.e. the legal settings of the elements and characteristics of a legally
binding offer. Therefore, the purpose of this research is to analyze the actual legal norms
that regulate an offer in the domestic legislation in relation to norms that regulate an offer in
certain international sources of law, determining their mutual setup and analyzing the need
of potential amendments of the norms that regulate an offer in the domestic legislation. The
main hypothesis during this research is that the regulation of an offer in the domestic and the
international sources of law is based on the same principles and there is no need for radical
changes of the legal regulation of an offer in the domestic legislation.
Aiming to achieve a structural research of the subject of interest in this paper, firstly we
get familiar with the minimum elements required for constitution of an offer and afterwards
we elaborate the specific characteristics and distinctions of an offer. The concluding chapter is
dedicated to sublimation and generating conclusions of the analyzed matters in this research
paper.
