CRIMINOLOGICAL ASPECTS OF THE KILLING A CHILD AT BIRTH COMMITED BY A WOMAN

The presence of a woman in the criminal records inevitably requires the
need for a detailed analysis of the criminological characteristics of every
crime in which she is registered as a perpetrator. The trend of increasing
such representation is evident both on a global scale and on a local level.
Emancipation entails its negative effects in the direction of increasing
women's presence as offenders. Normally, the shape, dynamics,
structure and frequency change according to the lifetime, but the
determination of the woman to engage in illicit behavior is strengthened.
Analyzing the type of criminal acts that a today woman performs, we
must mention that they are obligatory divided into two basic groups,
accordingly the separation of criminal acts on the basis of the subject.
They are, delicta communia and delicta propria. Starting from the
second ones, that is, from the special offenses, we must start with a
phenomenological analysis of the crimes in which, according to our
legislation, only the woman can appear as a perpetrator, in this case the
mother. The killing of a child at birth (or more commonly known as
infanticide) is an occurrence dating back to the ancient epoch, and along
with changing the shape, causes, or way of practicing, it persists to this
day. Analyzing the criminological aspects of the phenomenon, in its
phenomenology and etiology, we provide a more detailed introduction
to it and we are setting the possibilities for its prevention and treatment
in practice.
